Child Custody & Maintenance

Protecting your children's stability while securing their future.

At Harborview Law Chambers, we understand that nothing matters more to you than your children's wellbeing. Our approach to custody and maintenance matters is deliberately child-centered: we work to minimise disruption to their daily lives while securing arrangements that provide long-term stability and security.

These issues often arise within divorce proceedings, but they can also require independent attention—whether you are unmarried, separated, or seeking to vary an existing order. In every case, we bring measured advocacy, thorough preparation, and a firm commitment to discretion.

Care Arrangements

Care Arrangements in Singapore

Sole Custody

One parent holds exclusive authority over major decisions concerning the child's upbringing, including education, religion, and medical treatment.

The courts generally favour joint custody unless there are compelling reasons—such as an inability to cooperate or concerns about a parent's judgment. We advise clients carefully when sole custody is genuinely in the child's best interests.

Joint Custody

Both parents share decision-making responsibility for major long-term matters, reflecting the Singapore courts' strong preference for continued parental involvement.

This is the default position in most proceedings. We help clients structure workable joint custody frameworks that reduce future conflict and protect the child's sense of security.

Hybrid Arrangements

Split or alternating care arrangements divide day-to-day responsibility between parents, sometimes with one parent retaining final decision-making authority on specific issues.

These require precise drafting and realistic scheduling. We assist in designing arrangements that are genuinely sustainable for both parents and, above all, for the child.

Care and Control

The parent with care and control manages the child's daily routine—school, meals, bedtime—while the other parent typically has access rights.

This is distinct from custody (decision-making authority). We represent clients seeking care and control, as well as those seeking to ensure their access rights are meaningful and well-defined.

Access

The non-custodial parent's right to spend time with the child, which may be reasonable, structured, or supervised depending on the circumstances.

We advocate for access arrangements that preserve the parent-child relationship while addressing any genuine welfare concerns. Where necessary, we work with supervised access providers.

Child Maintenance

Legal Obligation

Under Singapore law, both parents share a duty to maintain their children, regardless of whether they are married, divorced, or separated. This obligation continues until the child reaches 21, or longer in certain circumstances such as ongoing education or disability.

What Maintenance Covers

Maintenance is intended to meet the child's reasonable needs, including school fees and educational expenses, healthcare and medical insurance, housing costs, and daily living expenses such as food, clothing, and transport.

How Amounts Are Determined

The courts consider each parent's income and earning capacity, the child's existing standard of living, specific needs and expenses, and any special circumstances such as medical conditions or extracurricular requirements. We present these factors clearly and proportionately.

Variation & Enforcement

When circumstances change—a parent's income rises or falls, or a child's needs evolve—existing orders can be varied. We also assist with enforcement proceedings where maintenance has fallen into arrears, seeking timely remedies through the Family Justice Courts.

Guidance

Common Questions

Can my child decide which parent to live with?

There is no fixed age at which a child's wishes become decisive. The courts may consider a mature child's views through interviews or reports, but the final decision always rests on what is in the child's best interests. We help parents understand how their child's voice is heard without placing undue pressure on them.

What if my former partner and I agree on everything?

If you reach agreement on custody, care, and maintenance, the terms can be recorded in a consent order and filed with the court. This gives the arrangement legal force and clarity. We draft these documents carefully to prevent ambiguity and future disputes.

How long do custody proceedings take?

Uncontested matters may be resolved in a matter of weeks. Contested proceedings typically take several months, depending on complexity, the number of issues in dispute, and court scheduling. We keep clients informed at every stage and work to avoid unnecessary delay.

Can maintenance orders be changed later?

Yes. Either parent may apply to vary a maintenance order if there has been a material change in circumstances—such as a significant change in income, the child's educational needs, or health requirements. We assist with both upward and downward variations.

What happens if maintenance isn't paid?

The recipient may apply to the Family Justice Courts for enforcement. The court has powers including garnishment, committal proceedings, and other remedies. We advise on the most effective and proportionate enforcement route in each case.

Do grandparents have any rights?

Grandparents do not have automatic legal rights to custody or access, but the courts may consider their role in the child's life when determining what arrangement serves the child's welfare. In some cases, grandparents may apply for access with the court's leave.

Can custody arrangements be made without going to court?

Yes. Parents are encouraged to agree on arrangements through negotiation or mediation. Agreements reached outside court can be formalised by consent order, giving them legal standing without the stress of litigation. We facilitate these discussions with a focus on preserving working relationships.

How does relocation overseas affect custody?

A parent who wishes to relocate a child overseas must obtain the other parent's consent or a court order. The courts apply a strict welfare test and require detailed proposals covering education, contact with the left-behind parent, and the child's overall wellbeing. We advise and represent clients on both sides of relocation applications.
