Navigating the process with discretion, clarity, and steady support. We guide you through each stage so you can make informed decisions with confidence.

The Framework

Understanding the Process

Divorce in Singapore follows a structured legal framework designed to ensure fairness while respecting the emotional weight of the decision. Understanding the requirements and stages helps set realistic expectations from the outset.

Eligibility

  • Marriage must have lasted at least 3 years before filing (limited exceptions apply)
  • At least one party must be domiciled in Singapore or habitually resident here for 3 years preceding filing
  • The marriage must be recognised as valid under Singapore law

The Two-Stage Process

  • Stage One — Dissolution: The court determines whether the marriage has irretrievably broken down based on established facts
  • Stage Two — Ancillary Matters: Resolution of custody, assets, maintenance, and all remaining practical arrangements

General timeline: An uncontested divorce may conclude within 4 to 6 months. Contested matters typically extend to 12 months or longer, depending on complexity and court availability.

Your Options

Contested and Uncontested Divorce

Every marriage is different, and so is every divorce. The path you take depends on whether both parties can reach agreement on the terms.

Uncontested Divorce

Duration4–6 months CostGenerally lower StressReduced adversarial tension

When both parties agree on all terms — including grounds for divorce, child arrangements, and division of assets — the matter proceeds on a simplified track.

This path is typically faster, more cost-effective, and less emotionally draining. Both parties file a draft consent order outlining agreed terms, and the court reviews and grants the divorce without requiring a contested hearing.

Even where agreement seems distant at first, many cases resolve through structured negotiation before reaching trial.

Contested Divorce

Duration12+ months CostHigher, stage-dependent StressGreater emotional demand

Where parties disagree on grounds, custody, maintenance, or asset division, the matter proceeds through the full court process.

This involves pleadings, disclosure of documents, and potentially multiple hearings or a full trial. The timeline and cost vary significantly with complexity.

Strategic representation is essential — not to escalate conflict, but to protect your interests while exploring every opportunity for settlement.

The Journey

What to Expect

Knowing what lies ahead reduces uncertainty. Here is how a typical matter progresses, from first conversation to final resolution.

01

Initial Consultation

A confidential discussion of your circumstances, concerns, and objectives. We outline your legal position, available options, and the likely path ahead — so you can decide your next step with clarity.

Duration: 60–90 minutes Your role: Share your situation openly; ask any questions
02

Filing and Service

We prepare the necessary documents — including the Writ for Divorce and Statement of Claim — and file them with the Family Justice Courts. The other party is then served with the papers and given time to respond.

Duration: 2–4 weeks Your role: Provide accurate information; review documents
03

Interim Matters

If urgent issues arise — such as maintenance, child custody, access arrangements, or personal protection — we can apply for interim orders to provide stability while the broader matter proceeds.

Duration: Varies by urgency Your role: Flag concerns promptly; provide supporting details
04

Negotiation and Settlement

We pursue resolution through correspondence, mediation, or collaborative approaches wherever possible. Most matters settle at this stage, sparing both parties the stress and cost of trial.

Duration: 2–6 months Your role: Engage constructively; consider proposals carefully
05

Trial (if contested)

If settlement proves impossible, the matter proceeds to trial. This involves court hearings, presentation of evidence, and cross-examination. We prepare thoroughly and represent you with measured advocacy.

Duration: 1–5 days (may span months) Your role: Attend hearings; provide testimony if required
06

Final Judgment and Ancillary Orders

The court grants the Decree Nisi, and after the mandatory waiting period, the Decree Absolute — formally ending the marriage. All ancillary matters (custody, assets, maintenance) are resolved by court order or consent.

Duration: 3 months after Decree Nisi Your role: Implement orders; update records
